Terms of Service

1. Acceptance of these terms

By downloading or playing Pimkim (“the app”), published by Hemant Chaudhary · Sudofish Labs (“we”, “us”), you agree to these Terms of Service. If you don’t agree, don’t use the app. You must be at least 13 years old to use Pimkim. If you’re under the age of majority where you live, a parent or guardian must agree to these terms for you.

2. Your license to play

We give you a personal, non-exclusive, non-transferable, revocable license to download, install and play Pimkim on devices you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from.

App Store downloads. If you got Pimkim from Apple’s App Store, Apple’s standard Licensed Application End User License Agreement also applies. These terms add to it; where the two conflict, Apple’s agreement governs. Apple isn’t responsible for the app or its support.

Google Play downloads. If you got Pimkim from Google Play, Google Play’s terms also apply to your download and purchases.

3. Pimkim Pro

  • Pimkim Pro is a one-time in-app purchase. It turns off the ads between runs, lets you use Second chance and Mend a broken power without watching an ad (still once per run), and gives the librarian a golden bookmark.
  • Payment is handled by Apple or Google. Prices are shown in the store before you buy and may vary by country.
  • Pimkim Pro belongs to the Apple Account or Google account that bought it. Use Restore Purchase in Settings to get it back on a new device or after reinstalling. A purchase on iPhone or iPad doesn’t carry over to Android, or the other way round.
  • Refunds are handled by Apple or Google under their refund policies and the consumer laws that apply to you. We can’t issue refunds ourselves.
  • Testers and players we help through support may get Pimkim Pro for free. It works the same way, and we may end a free grant when a test ends.

4. Ads

The free version of Pimkim shows ads served by Google AdMob: rewarded ads you choose to watch, and full-screen ads between runs. Ads are provided by third parties, and we don’t control or endorse what they advertise. If you see an ad that seems inappropriate, tell us at [email protected]. How ads use data is explained in our Privacy Policy.

5. The Android beta

Beta versions are unfinished. They may have bugs, change, lose progress or stop working, and we may end the beta at any time. Please don’t share beta builds or test links with people who aren’t in the test. Signing up doesn’t guarantee a place in the beta.

6. Acceptable use

Play fair and follow the law. Don’t:

  • copy, modify, sell, rent or redistribute the app, or remove its notices;
  • reverse engineer, decompile or disassemble the app, except where the law allows it;
  • get around ads, purchases or other limits, or tamper with the app or the services it uses;
  • use bots or false details on our website or the beta sign-up, or try to disrupt them;
  • use the app or its content in a way that infringes anyone’s rights.

7. Intellectual property

Pimkim, including its code, design, characters (the Pimkims and the librarian), art, sounds, music, text and names, belongs to Hemant Chaudhary · Sudofish Labs or our licensors. Fonts and other third-party components are used under their own licenses. You’re welcome to share screenshots and videos of your games, as long as you don’t suggest we endorse you.

If you send us ideas or feedback, we may use them without owing you anything.

8. Third-party services

Pimkim relies on services from Apple, Google (AdMob and Firebase) and RevenueCat. Their own terms and privacy policies apply to them, and we aren’t responsible for their availability.

9. Disclaimer of warranties

Pimkim is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. We don’t promise that the app will be uninterrupted, error-free or always available, or that your progress will never be lost.

10. Limitation of liability

To the maximum extent the law allows, Hemant Chaudhary · Sudofish Labs isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost progress, data or profits. Nothing in these terms limits rights or liabilities that can’t be limited by law.

11. Indemnification

To the extent the law allows, you agree to indemnify and hold harmless Hemant Chaudhary · Sudofish Labs against claims arising from your misuse of the app or your breach of these terms.

12. Termination

You can stop using Pimkim at any time by deleting it. We may suspend or end your license if you break these terms, for security reasons or if the law requires it. We may also change or stop offering the app; if we do, features that depend on online services, such as purchases, may stop working.

13. Governing law

These terms are governed by the laws of India, without affecting the mandatory consumer protections of the country where you live.

14. Changes to these terms

We may update these terms. We’ll post changes on this page and update the date at the top. If you keep playing after a change, the new terms apply.
